Hereinafter referred to as "The Provider",

AND

Any student of the "Detchen French Teacher – Fantastic Ms French" school
Hereinafter referred to as "The Student",

The provider and the student named above are referred to together as "The Parties", or separately as "The Party".
​
Preamble
The provider reserves the right to modify these terms and conditions at any time. Nevertheless, the version in force at the date of the student's order is the one applicable at the time of purchase. When such a change has an impact on the nature of the relationship between the parties, the service provider will notify the student at the e-mail address provided at the time of purchase.
Article 1 - Services
The Provider offers services for the purpose of teaching French online via a videoconferencing platform, hereinafter referred to as "Courses". The Provider provides the Courses itself, or delegates them to another French teacher.

The provider offers two types of courses.

1.1 - Online beginners' course
​
The beginner's course consists of structured instruction designed to teach the basics of French. It lasts 50 minutes.
​
Concerning the materiel, before the start of the course, depending on the method chosen during the discovery call:
- Either the student receives a written support in electronic format for his/her/their lessons, and instructions for creating a free account on the Quizlet platform (which the student is free to use or not) to access flashcards for the lessons during the time of the package.
- Or the student is required to buy the textbook.
The student is informed of and accepts the workload involved in preparing the lessons.
At the start of each lesson, the Provider asks for the student's consent before starting the recording (via a request generated by the videoconferencing tool). If the student agrees to the recording of his/her/their camera and microphone, the provider starts the recording. If the student refuses, the provider will not start the recording. The recording is made for educational purposes and will only be broadcast to students or the team. The recording is kept for a period of two (2) weeks. No other use will be made of it, in which case written authorization from the students will be requested.
If the course is given to two students (duo course), and at least one student is present, the lessons are recorded by the videoconferencing tool used by the Provider. The student hereby gives their consent to the recording of his/her/their camera and microphone.

1.2 - Online conversation courses
​
The conversation course consists of practicing oral French through conversation, in a relaxed environment adapted to the needs and desires of the student. It lasts 50 minutes.
​
Before the course begins, the student receives a link to an online shared folder. After each lesson, within seventy-two (72) hours, the service provider makes a written (maximum 1 page) and audio report of the lesson available in the shared folder. If the student does not receive the report within this period, the student is invited to notify the provider by e-mail at the following address:

Article 2 - Prices
Prices are quoted in euros (€). VAT is not applicable in application of article 293 B of the French General Tax Code.
The Service Provider reserves the right to modify the rates. The new price will only apply to packs purchased after the price change.

2.1 - Individual lessons
For individual lessons :
- The 3-course pack is 195 euros (€).
- The 5-course pack costs 320 euros (€).
- The 10-course pack costs 620 euros (€), payable in 2 monthly instalments of 310 euros (€),
- The 20-lesson pack costs 1200 euros (€), payable in 4 monthly instalments of 300 euros (€),
2.2 - Duo lessons
For duo lessons (two students):
- The 10-class package costs 320 euros (€) per person, payable in 2 monthly instalments of 160 euros (€),
- The 20-class package costs 600 euros (€) per person, payable in 4 monthly instalments of 150 euros (€),

Article 3 - Payment
Payment for courses is made by credit card using a Stripe payment link, which is sent by the provider to the student. The Stripe tool is independent of the provider, who has no access to the student's bank details.

Payment may be made in instalments under the conditions set out in article 2. In this case, the parties agree on the due dates by email.
If the student encounters a payment problem, he/she/they shall inform the service provider as soon as possible by e-mail to the following address

Payment must be made at least forty eight (48) hours before the start of the course. It conditions the student's enrolment. No service will be provided without payment. If the student pays in instalments, any delay in payment immediately suspends services.
Invoices will be issued at the end of each month and sent to students.

Article 4 - Period of validity
Packs are valid for six (6) months from the date of purchase.
Article 5 - Lateness and absence
In the event of lateness, the provider will wait for the student(s) for a maximum of fifteen (15) minutes. If the student is present within this time, the course will be provided by the supplier, but the time lost will not be made up. If, after this time, no student shows up, the lesson will not be made up and will be billed.
If the provider arrives late, the parties agree on a time to make up the lost time.

Article 6 - Course cancellation

6.1 - Individual courses
No cancellation is possible. If a student is unable to attend a lesson, no refund or reduction will be made on the initial price.
​
If the provider is unable to provide a lesson, the student may recover the lost lesson free of charge.
​
6.2 - Group lessons
No cancellations are possible. If a student is unable to attend a lesson, no refund or reduction will be made on the initial price. The absent student may view the recording, which is kept for a period of two (2) weeks. If both students are absent, the course is not insured and no recording is made.
​
If the service provider is unable to provide a lesson, students may recover the lost lesson free of charge.
​
Article 7 - Course postponement/rescheduling
7.1 - Individual course
​
If the student chooses a 3-course pack, rescheduling is not possible.
​
From a pack of 5 classes upwards, the student has the right to change the date of the course already set within the following limit:
​
- 5 classes: 1 rescheduling possible,
- 10 classes: 2 rescheduling possible,
- 20 classes: 4 rescheduling possible.
​
The student must request the postponement no later than forty-eight (48) hours before the start of the course. To request a change, the student must write to the provider by e-mail at the following address

If the parties are unable to agree on a new time slot, the course will remain as originally scheduled.

7.2 - Group courses
​
No rescheduling is possible. If a student is unable to attend a course, no refund or reduction will be made on the initial price. The absent student may view the recording, which is kept for a period of two (2) weeks. If both students are absent, the course is not insured and therefore no recording is made.
If the service provider is unable to provide a lesson, the students will recover the lost lesson free of charge.
Article 8 - Force majeure
Any event beyond the control of the Parties, qualified as force majeure within the meaning of article 1218 of the French Civil Code, shall be considered as a cause for exoneration from their obligations and shall result in the suspension of the service. This event must prevent the Parties from fulfilling their obligations in the manner normally provided for in these general terms and conditions of sale. In such a case, the Parties shall contact each other as soon as possible to agree on new terms for the performance of the service. The Service Provider cannot be held liable in such circumstances.

Article 9 - Right of withdrawal
If the student wishes to exercise his right of withdrawal, his decision must be notified by means of an email to the service provider within fourteen (14) days of the purchase of the pack, at the following address

After this period, the order is definitively validated.

The classes already taught will not be refunded.
​
Article 10 - Confidentiality
Personal data provided by each of the parties is protected by the laws and regulations applicable to personal data, and in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation), which will be used for the performance of the general terms and conditions of sale.
Each party undertakes, in the event that it obtains or becomes aware of personal data/documents belonging to the other party, to treat them in accordance with the laws and regulations applicable to personal data.

Article 11 - Consumer disputes and mediation
The applicable law is French law. In the event of a dispute between the Provider and the Student, the Provider and the Student will endeavour to resolve the dispute amicably. The Customer shall send a written complaint to the Provider by e-mail to the following address

In the absence of an amicable agreement, or in the absence of a response from the Provider within a reasonable period of one (1) month, the student, a consumer within the meaning of Article L.133-4 of the French Consumer Code, has the possibility of referring the matter free of charge, if a disagreement remains, to the competent mediator registered on the list of mediators drawn up by the Commission d'évaluation et de contrôle de la médiation de la consommation in application of Article L.615-1 of the French Consumer Code, namely :

In the event of a referral, the student must provide all the information required to deal with the dispute: surname, first name, email address, postal address, nature of the request, statement and description of the facts as well as any useful documents, prior discussions and proposed solution. It is imperative that the student refer the matter to the mediator in writing and in French.
If the mediator's response is not satisfactory, and in all other cases, the competent court is that of the service provider's registered address.
